These terms govern your use of WorkAndGo, the team communication and workforce management platform operated by Fintech Development Pty Ltd ("we", "us", "WorkAndGo"). By using WorkAndGo, you agree to these terms.
1. The service
WorkAndGo is a platform that combines team messaging, voice and video calls, task management, calendar, HR tools, and AI assistance into a single workspace. It is designed for organisations and their employees.
We provide WorkAndGo as a software-as-a-service (SaaS) product. Your employer (or the organisation that invited you) subscribes to the service and provides you with access.
2. Your account
Your employer creates your WorkAndGo account as part of their organisation's workspace. Here is what you need to know:
- Your account belongs to your organisation's workspace. If you leave the organisation, your employer may deactivate your account.
- You are responsible for keeping your login credentials secure. Do not share your password or session tokens.
- If you suspect unauthorised access to your account, notify your admin immediately and email [email protected].
- You must provide accurate profile information. Do not impersonate others.
3. Acceptable use
WorkAndGo is a workplace tool. When using it, you agree to:
- Respect confidentiality. Do not share confidential company information outside the platform through screenshots, copy-paste, or any other method, unless authorised by your employer.
- Use it lawfully. Do not use WorkAndGo for any illegal purpose, including harassment, discrimination, or distribution of illegal content.
- Not circumvent monitoring. If your employer has enabled productivity monitoring, do not attempt to manipulate, disable, or circumvent those features. If you have concerns about monitoring, raise them with your employer.
- Not abuse the platform. Do not attempt to access other organisations' data, reverse-engineer the software, or use automated tools to scrape content.
- Follow your employer's policies. Your employer may have additional acceptable use policies that apply alongside these terms.
4. Your employer's role
Your employer is the data controller. They decide what features to enable, what monitoring to turn on, how long data is retained, and who has admin access. WorkAndGo provides the tools -- your employer configures them.
Specifically, your employer:
- Controls which monitoring and productivity features are active
- Sets data retention policies for messages, screenshots, and telemetry
- Manages user access -- they can add, remove, or modify your account
- Configures compliance rules and alert thresholds
- Designates admin users who can view team analytics and individual activity data
If you have questions about what data is collected about you and how it is used, your employer is your first point of contact. You can also review the Privacy Policy and check the My Productivity page within WorkAndGo.
5. Our role
WorkAndGo is the data processor. We provide and maintain the platform on behalf of your employer. Here is what that means in practice:
- We host and process your data according to your employer's configuration
- We do not access your organisation's data unless specifically requested for technical support, and only with your admin's consent
- We do not sell, share, or use your data for advertising -- ever
- We maintain the security and availability of the platform
- We provide updates and improvements to the service
6. Intellectual property
Your content. Messages, files, documents, and any other content you or your team create within WorkAndGo belong to your organisation. We do not claim ownership of your content. We store and process it solely to provide the service.
Our platform. WorkAndGo -- the software, design, branding, and underlying technology -- is owned by Fintech Development Pty Ltd. These terms grant you a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose.
AI-generated content. Summaries, reports, and responses generated by Jeeves AI are provided as-is. Your organisation owns the output, but we make no warranty about its accuracy. Always verify AI-generated information.
7. Availability
We target 99.9% uptime for the WorkAndGo platform. That said:
- We do not guarantee uninterrupted service. Maintenance windows, infrastructure issues, and force majeure events can cause downtime.
- We will notify your organisation's admin of planned maintenance at least 24 hours in advance.
- Our status page at status.workandgo.com.au provides real-time service status.
- Enterprise plans include uptime SLAs with service credits for downtime exceeding agreed thresholds.
8. Limitation of liability
To the maximum extent permitted by Australian law:
- WorkAndGo is provided "as is." We make no warranties beyond what is stated in these terms and any applicable service level agreement.
- We are not liable for decisions your employer makes based on data or insights generated by WorkAndGo, including productivity reports, compliance alerts, or AI-generated summaries.
- Our total liability to your organisation for any claims arising from the use of WorkAndGo is limited to the amount your organisation paid us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, or consequential damages, including lost profits or data loss -- except where such limitation is prohibited by law.
Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law.
9. Subscriptions, billing and refunds
- WorkAndGo subscriptions are managed through your MyAndGo account. Billing, plan changes, and cancellation are handled by the MyAndGo platform.
- No refunds for change of mind. Fees already paid are not refundable simply because your organisation changes its mind or no longer wishes to use the service. Where a plan is cancelled, access and any included allowance continue until the end of the paid period and are not refunded as cash.
- Nothing in this clause excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law, including the right to a refund where the service is not delivered or fails to meet a consumer guarantee.
10. Termination
- Your employer can remove your access to WorkAndGo at any time by deactivating your account.
- Your employer can cancel their WorkAndGo subscription. Upon cancellation, we retain data for 30 days to allow for export, then permanently delete it.
- We can suspend or terminate accounts that violate these terms. We will provide notice and an opportunity to remedy the violation where reasonably possible.
- We can terminate the service entirely with 90 days notice to all customers.
11. Changes to these terms
We may update these terms from time to time. When we do:
- We will notify your organisation's admin via the WorkAndGo app
- Material changes will be communicated at least 30 days before they take effect
- Continued use of WorkAndGo after the effective date constitutes acceptance of the updated terms
- If your organisation does not agree to updated terms, they may cancel their subscription
12. Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your use of WorkAndGo will be subject to the exclusive jurisdiction of the courts of New South Wales.
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
